What is Tapu in TURKEY?
What is Tapu (Title Deed) in TURKEY? When you purchase real is that in Turkey, You will get a TAPU (title deed) instead, a ‘Title Deed’ in English. A TAPU (Title Deed) is an extract from the Turkish real estate registry Tapu office. Your full name display on your real estate registry, also known as TAPU office, is comparable to the Land Register in the UK. On the TAPU you will find in short the following information: location, a photograph of the owner, type of TAPU, data of the real estate and archiving data.
There are red and blue TAPU’s.
A red TAPU is for a common hold (Condominium in the US). You get a red TAPU if you buy an apartment in an apartment complex or a villa real estate in a project.
A blue TAPU can have different legal meanings
- Real estate land
- Farm land
- Real estate land. There’s already a real estate on the plot
A blue TAPU is not a common hold.
Most foreigners who buy a house in Turkey will receive a red TAPU (Title Deed). The red TAPU is, therefore, the subject of this article.
There are 2 types of red TAPU’s. (Title Deed). The first red TAPU (Title Deed). Is of the type ‘Kat irtifaki’. This type indicates that you legally own the land and the off plan real estate in Turkey.
You receive the second red TAPU (Title Deed) at the end of the buying process when you sign the contract at the TAPU (Title Deed) office. This TAPU (Title Deed) is of the type ‘Kat Mülkiyeti’ and indicates that you are the legal owner of the land or plot and the complete real estate
Obtaining a TAPU (Title Deed) of type ‘Kat Mülkiyeti’ is a lengthy process with pitfalls and obstacles. Foreigners should hire an independent Turkish Solicitor lawyer to guide them through the buying process. Underneath I have added some links to English speaking Solicitor lawyers operating in Turkey.
The TAPU (Title Deed) is a snapshot and may be outdate. So rely never solely on the information on a TAPU (Title Deed) but always check the data in the Land Register office.
Although the TAPU (Title Deed) is no more than an extract from the Land Register office, it still has great symbolic value. With a TAPU (Title Deed), you will be owner of the real estate in Turkey
